GEC, Jane Fraser file TRO to stop Glynn County from constructing roundabout

Glynn Environmental Coalition (GEC) and Jane Fraser filed a temporary restraining order that could, depending on the ruling, stop Glynn County from moving forward with the Sea Island Road / Frederica Road roundabout.
The lawsuit asks that Glynn County be enjoined “from taking any action to encroach upon, develop, or otherwise alter Twitty Park, including but not limited to the construction of a roundabout or other public roadworks in furtherance of the Roundabout Project at the intersection of Frederica Road and Sea Island Road.”
According to the lawsuit T.L. Cain deeded Twitty Park, which is bisected by Sea Island Road, to Glynn County with the provision if the land ceases to be used as a park, title reverts to Cain’s successors.
The lawsuit states that GEC, Fraser and two other plaintiffs, Darion Williams and Elizabeth Williams, both residents of Arizona, are common owners of a possible reverter interest in Twitty Park.
The lawsuit states that the Cain deed to the County created a “defeasible fee” meaning county ownership could be revoked if the Park were not used as a park.
Plaintiffs want the Court to declare that Glynn County may not abandon Twitty Park’s use as a public park including relocating the utility lines per the Utility Relocation Agreement recently signed with Georgia Power or other roadwork including a roundabout without approval by referendum.
The same plaintiffs also filed a lawsuit asking that the court declare that Glynn County cannot abandon Twitty Park’s use as a public park including relocation of existing power lines or further development of Twitty Park for roadwork; that the County is obligated to maintain the park as a public park.
Once that is done that an injunction be issued to prohibit Glynn County from developing Twitty Park for a roundabout or other roadwork or declare that Twitty Park reverted to the “Holders of the Reverter including the plaintiffs.”
